• Digital Products: Available for immediate download after successful payment
• Physical Products: Shipped according to Seller's shipping policy
• Services: Delivered as per the service description and agreement with Seller
• Courses: Access provided as described in the course listing

4.3 Refunds & Disputes

Refund requests must be submitted within 30 days of purchase, subject to our Refund Policy. Disputes should be resolved directly with Sellers before escalating to Platform support.

5. Seller Terms

As a Seller on Marketly, you agree to:

• Set fair and reasonable prices
• Clearly state shipping costs and delivery timelines
• Maintain sufficient stock/inventory for listed products

5.2 Transaction Fulfillment

You are responsible for fulfilling orders promptly and as described in your listings. Failure to deliver may result in account suspension.

5.3 Commission Fees

Marketly charges a commission on each sale. The current commission rate is displayed in your Seller Dashboard and may be updated with prior notice.

6. Transactions & Payments

6.1 Pricing

All prices are listed in Zambian Kwacha (ZMW) unless otherwise specified. Prices are subject to change without notice.

6.2 Taxes

You are responsible for any applicable taxes associated with your transactions. We may collect and remit taxes as required by law.

6.3 Payment Disputes

Payment disputes must be reported within 7 days of the transaction. We reserve the right to investigate and resolve disputes at our discretion.

7. Intellectual Property

7.1 Platform Ownership

The Platform and its original content, features, and functionality are owned by Marketly and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 User Content License

By posting content on the Platform, you grant Marketly a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for Platform operations.

7.3 Copyright Infringement

We respect intellectual property rights. If you believe your copyright has been infringed, please contact us at support@marketlynetwork.com.

8. User Content

You are solely responsible for the content you post on the Platform. You agree not to post content that:

• Is illegal, harmful, or offensive
• Infringes on intellectual property rights
• Contains viruses or malicious code
• Is false, misleading, or deceptive
• Violates any third-party privacy rights

We reserve the right to remove any content that violates these Terms without prior notice.

12. Limitation of Liability

IN NO EVENT SHALL MARKETLY, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

Our total liability to you for all claims arising from these Terms shall not exceed the greater of:

• The amount you paid to us in the last 12 months, or
• One hundred Zambian Kwacha (ZMW 100)

13. Indemnification

You agree to indemnify and hold harmless Marketly and its affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your products or content

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Zambia, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through arbitration in Lusaka, Zambia, in accordance with Zambian arbitration laws.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Platform after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Platform.
